How a DataQs Challenge Removes Violations From Your CSA Score

Your record should show what happened. Nothing more.

Every roadside inspection and every crash goes on your public FMCSA record and counts in your CSA scores for 2 years. A warning with no ticket counts the same as a ticket.

Most carriers never challenge anything. They don't know what can be fixed, or they think it takes a lawyer. It doesn't. FMCSA's DataQs system is how a record gets corrected, and anyone can file.

Truck Service Hub reads your report, checks it against your records, and tells you if it's worth challenging. If it is, we write the request, file it in DataQs, and follow it to the end.

Pro tip: send the report as soon as you get it. Logs, dashcam video and the police report are easier to get in the first weeks than months later.

5 THINGS WE CHECK BEFORE WE TAKE YOUR CASE

Every case goes through the same check. If it doesn't pass, we tell you why, free.

  1. 1 "Was it your truck?" Plate, VIN and USDOT on the report against your fleet and your driver list.
  2. 2 "Does the code match what happened?" The violation code against the officer's notes and the facts on the report.
  3. 3 "Ticket or warning?" A ticket can be fought in court. A warning has no court case, so DataQs is the only way it comes off.
  4. 4 "Was the crash preventable?" The police report against the crash types FMCSA reviews for preventability.
  5. 5 "What do your records show?" ELD logs, GPS, fuel receipts, dashcam. If they back the driver, we file. If they don't, we stop.

Have ready: a photo of the inspection report or police crash report, your USDOT number, and any logs or video from that day.

WHICH DATAQS CHALLENGES WIN: OUR CHANCES, STRAIGHT UP

We don't take every case. We go after the ones your records can prove, and we tell you the odds on the rest before you pay a dollar.

STRONG CHANCE

We go after these first.

  • Not your truck. The inspection or crash went on your USDOT number, but the truck wasn't running under your authority. The whole inspection can come off.
  • A crash you didn't cause. Hit from behind, hit while parked or legally stopped, hit by a driver going the wrong way or under the influence, or you hit an animal or road debris. FMCSA's Crash Preventability Determination Program can mark it "not preventable".
  • Dashcam shows it. Any crash with video that shows how it happened can go to FMCSA's preventability review.
  • Ticket dismissed in court. Dismissed or not guilty, the violation can come off. We file the court paper for you.
  • The report doesn't match the facts. The wrong violation code, the same thing counted twice, a speed range higher than what the officer measured.

WORTH A TRY

Lower odds, real grounds.

  • A documented ELD problem. A malfunction, a connection drop, or unassigned driving handled the right way.
  • Personal conveyance used right. Off duty, for a personal reason, not moving the load closer to delivery.
  • An English check with skipped steps. The officer didn't do the interview and the sign test the way FMCSA requires.
  • Hours the clock didn't account for. A split sleeper-berth period or bad weather and traffic the driver couldn't have known about.
  • A lane restriction with no sign. Nothing restricted trucks at that spot, or the driver was only passing, exiting or turning.

WE'LL TELL YOU NO

And you pay nothing.

  • The log was false, and the scale or camera proves it.
  • The defect was real.
  • There are no records to back the driver's side.

DATAQS AND CSA QUESTIONS, ANSWERED

DataQs is FMCSA's online system for asking that a record be corrected. A challenge, called a Request for Data Review, goes to the state agency that wrote the inspection, or to FMCSA for crashes. If they agree the record is wrong, the violation or crash is changed or removed, and your CSA scores update.

Through FMCSA's Crash Preventability Determination Program, filed in DataQs with the police report. It covers crashes like being hit from behind, hit while parked, hit by a wrong-way or impaired driver, animal strikes, and crashes caught on video. We check the police report first and tell you if your crash fits.

Yes. Send the report, and within 24 hours we tell you if it's worth challenging. You only pay if we file.

$199 flat per inspection or crash, paid when we take your case. It covers every violation on that report and all three review stages. If we don't take the case, you pay nothing. Once we file, the fee isn't refundable, whatever the state decides.

No, and nobody honest can. The state agency decides inspections, and FMCSA decides crashes. What we promise is that we only file what your records back up, and we tell you the odds before you pay.

The state has to open the request within 7 days and decide the first stage within 21 days. Reconsideration takes up to 21 more days, and Final Review up to 45.

Yes, the same as a ticket. And since there's no court case, a DataQs challenge is the only way a warning comes off.

Often, yes. If the court dismisses it or finds him not guilty, we file the court paper with FMCSA and the violation can come off. FMCSA's public data lists 16,652 violations marked "Not Guilty/Dismissed".

Until FMCSA reviews it, yes. A crash marked "not preventable" still shows on your record, but it no longer counts in your crash score.

No. We never ask for it.

No. Truck Service Hub is not a law firm and doesn't go to court. We prepare and file DataQs requests.
