These Terms of Use ("Terms") govern your use of the Truck Service Hub website and platform (the "Site" or "Service"), and specifically apply to any truck driver or individual ("Driver," "you," or "your") who browses driving opportunities, submits a driver application or inquiry, or is contacted by TSH through an ad, lead form, phone call, or text about a driving opportunity — whether that form appeared on our own website or on Facebook, Instagram, or elsewhere. These Terms are separate from — and in addition to — our Privacy Policy, which governs how we collect, use, and share your personal information. These Terms are also separate from our Vendor Terms of Service, which govern businesses that list on the Platform.

By using the Site, submitting a driver application or inquiry, or clicking "I agree," you accept these Terms. If you do not agree, do not use the Site or submit your information to TSH.

1. Who These Terms Apply To

These Terms apply to any driver, job-seeker, trucking company representative, or other individual who visits, browses, or uses the Site, and specifically to anyone who submits a driver application or inquiry to TSH — through our website, a Facebook or Instagram lead form, a phone call, or any other channel. Businesses that list as paid or free Vendors on the Platform are covered separately by our Vendor Terms of Service.

2. The Service

TSH operates an online platform that connects truck drivers with trucking companies ("Carriers"), and separately connects drivers and Carriers with other trucking-industry vendors (repair shops, insurance, fuel cards, tires, towing, and similar services) listed on the Platform.

TSH is a matching, recruiting, and advertising service. TSH is not an employer, staffing agency, motor carrier, or broker, and does not hire, employ, dispatch, supervise, schedule, or pay you. Any driving position, employment, or independent-contractor relationship you enter into is solely between you and the Carrier — TSH is not a party to it.

The Service is free to drivers. TSH never charges you a fee to browse openings, submit an application, or be matched with a Carrier or vendor. TSH is compensated by Carriers and vendors, not by drivers.

3. Eligibility & Accuracy of Information

  • The Service is intended for individuals 18 years of age or older. By using the Service, you represent that you are at least 18.
  • You represent that any information you submit — including your name, contact information, CDL class and endorsements, driving experience, availability, and driving record — is true, accurate, and not misleading, and that you will update it if it changes.
  • You are solely responsible for holding a valid CDL and any other license, certification, or authorization required for the position you are applying to.

4. How Matching Works; No Guarantee of Employment or Results

  • When you submit an application or inquiry, TSH may share your information with one or more Carriers or vendors for their evaluation, as described in our Privacy Policy.
  • TSH does not guarantee that you will receive any job offer, interview, placement, or match. TSH does not guarantee any specific pay rate, CPM, weekly income, home time, equipment, benefits, route, or working condition, and does not guarantee that a Carrier will honor any pay or terms advertised in a job posting, ad, or conversation with a recruiter.
  • Where our marketing describes a Carrier, job posting, or offer as "verified," "real," or similar, that means TSH has taken reasonable steps to confirm the Carrier is an operating, legitimate trucking business — it is not a guarantee of the accuracy of any specific pay figure, job detail, or promise made by that Carrier, and it is not TSH's certification of how that Carrier treats its drivers.
  • TSH is not responsible for delays, cancellations, or changes to a job opportunity made by a Carrier, or for a Carrier's failure to respond to or follow up with you.

5. No Endorsement; Relationship With Carriers Disclaimer

TSH does not employ, control, supervise, or guarantee any Carrier or vendor, and is not a party to your employment, contractor relationship, or any transaction between you and a Carrier or vendor. Any dispute, claim, injury, unpaid wage, discrimination claim, workplace safety issue, accident, termination, or other matter arising from your actual employment or work with a Carrier is strictly between you and that Carrier. TSH is not responsible for it.

If you are contacted by a recruiter working with TSH, that recruiter is presenting opportunities from one or more Carriers TSH works with — not offering you a job on TSH's own behalf.

6. Acceptable Use

You agree not to: submit false or misleading information; use the Site to harass, spam, or send unsolicited messages to Carriers, vendors, or other users; scrape, copy, or reuse Site content or listings for a competing service; attempt to interfere with or disrupt the Site; or use the Service for any unlawful purpose. TSH may suspend or terminate your access to the Service, without notice, for any violation of this section. Sections 7 (Indemnification), 8 (Limitation of Liability), 9 (Intellectual Property), and 10 (Governing Law, Venue & Disputes) survive any suspension, termination, or discontinuation of your access to the Service.

7. Indemnification

You agree to indemnify, defend, and hold harmless Truck Service Hub LLC, its sole member, and Marko Cekerevac individually, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) false or misleading information you submit; (b) your breach of these Terms; (c) your violation of any law or a third party's rights; or (d) your actual employment, contractor relationship, or dealings with a Carrier or vendor.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TSH DOES NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. TSH IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOST WAGES, LOST OPPORTUNITY, OR LOST EMPLOYMENT, EVEN IF ADVISED OF THE POSSIBILITY.

BECAUSE THE SERVICE IS FREE TO DRIVERS, TSH'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO ONE HUNDRED DOLLARS ($100). YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT. THIS LIMITATION APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW EVEN IF A REMEDY UNDER THESE TERMS FAILS ITS ESSENTIAL PURPOSE.

9. Intellectual Property

TSH retains all rights, title, and interest in the Site, its software, design, content, and trademarks. You may not copy, reproduce, or use TSH's name, logo, or content except as needed to use the Service for its intended purpose.

10. Governing Law, Venue & Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

Exclusive Venue. Any claim or dispute arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Wyoming. You consent to personal jurisdiction in those courts and waive any objection that Wyoming is an inconvenient forum, regardless of where you are located.

Class Action Waiver. Any claim must be brought by you individually, in your own name, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You waive any right to participate in such a proceeding against TSH.

Jury Trial Waiver. To the fullest extent permitted by law, you and TSH each waive any right to a trial by jury in any action arising out of or relating to these Terms.

Time Limit on Claims. Any claim you have arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose, or it is permanently barred, regardless of any longer period that might otherwise apply by law.

Attorneys' Fees. In any dispute between you and TSH arising from these Terms, the party that prevails is entitled to recover its reasonable attorneys' fees and costs from the other party.

11. Changes to These Terms

TSH may update these Terms from time to time. Material changes will be posted on this page with an updated Effective Date. Continued use of the Site or Service after changes take effect is your acceptance of the updated Terms.

12. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and TSH regarding the Service. If any provision is found unenforceable, the rest remains in effect. TSH's failure to enforce a provision is not a waiver of it. Neither party is liable for delays caused by events beyond its reasonable control. Notices to TSH should go to the contact information below. Your electronic acceptance of these Terms — including by checking a box or clicking "I agree" — is a legal signature and is as binding as a handwritten signature, to the fullest extent permitted by the U.S. ESIGN Act and applicable state law.

This document is provided for general informational purposes and is not legal advice. It has not been reviewed by a licensed attorney. Because these Terms apply to individual consumers using a free service — not businesses under a paid contract like the Vendor Terms of Service — the class-action waiver, jury-trial waiver, and fee-shifting language in Section 10 carry a higher risk of being challenged as unconscionable than the same language does for Vendors.
