These Vendor Terms of Service ("Terms") govern any business or individual ("Vendor," "you," or "your") that creates a vendor account, purchases a paid subscription plan, or otherwise lists products or services on the Truck Service Hub platform ("Platform" or "Service"). These Terms are separate from — and in addition to — our Privacy Policy, which governs how we handle personal information for drivers and vendors alike.

By creating a vendor account, selecting a paid plan, completing checkout, or clicking "I agree," you accept these Terms on behalf of yourself and, if applicable, the business you represent. If you do not agree, do not create a vendor account or use the vendor features of the Platform.

1. Who These Terms Apply To

These Terms apply to any vendor, shop, carrier, service provider, or company that lists on TSH as a paid or free vendor — including but not limited to truck and trailer repair shops, fuel card providers, insurance providers, tire services, towing services, and trucking companies. Truck drivers and other individuals browsing the Platform for free are covered separately under our Privacy Policy and are not "Vendors" for purposes of these Terms.

2. The Service

TSH operates an online directory and marketplace that lists trucking-industry vendors for truck drivers and trucking companies to discover. Depending on the plan you select, TSH may provide a business listing, category placement, a banner ad, featured placement, or early access to driver leads, as described on our pricing page at the time of your purchase.

TSH is a marketplace and advertising platform only. TSH does not employ, control, supervise, or guarantee any Vendor, and is not a party to any transaction, service, sale, or agreement between a Vendor and a driver, trucking company, or any other Platform user. See Section 6 below.

3. Subscription Plans, Fees & Billing

  • Current plans, features, and pricing are shown at truckservicehub.us/pricing and confirmed at checkout. The specific plan and price you agree to is the one displayed and confirmed when you complete signup — that confirmation controls over any older or conflicting price shown elsewhere.
  • Paid subscriptions are billed monthly in advance and automatically renew each month until canceled, using the payment method you provide through our payment processor (Stripe). By subscribing, you authorize TSH and Stripe to charge that payment method on a recurring basis until you cancel.
  • If a payment fails, TSH may flag your account and restrict or remove your listing from public view until the balance is resolved, without further notice.
  • TSH may change subscription pricing or plan features with at least 30 days' notice to the email on file. Continued use of a paid plan after a price change takes effect is your acceptance of the new price; if you don't agree, you may cancel before the change takes effect.
  • By providing a phone number to TSH, you consent to be contacted by TSH by phone call, text message (SMS), or email regarding your account, billing, and support. Message and data rates may apply. You can opt out of non-essential communications at any time by contacting info@truckservicehub.us.

4. Cancellation & Refunds

  • There is no long-term contract. You may cancel your subscription at any time from your account dashboard or by emailing info@truckservicehub.us.
  • Cancellation stops future billing but takes effect at the end of your current paid billing period — your listing remains active through the period you already paid for.
  • Payments already made are non-refundable, including for partial months, except where required by law or expressly agreed by TSH in writing.
  • TSH may also suspend, downgrade, or remove your listing for non-payment, as described in Section 3.

5. Vendor Eligibility, Verification & Content

  • You represent that you are lawfully authorized to offer the products or services you list, that you hold all licenses, permits, insurance, and operating authority required by law to provide them (including any DOT, state, or industry-specific requirements), and that all information you submit to TSH is accurate and kept up to date.
  • TSH may review, verify, decline, suspend, or remove any Vendor or listing at any time, for any reason or no reason, in TSH's sole discretion — including where TSH cannot verify your business, licensing, or insurance.
  • You are solely responsible for the content of your listing, banner ads, descriptions, pricing, and any claims you make to drivers or other users. TSH may remove content it reasonably believes is false, misleading, unlawful, or harmful, without liability to you.

6. No Endorsement; Marketplace Disclaimer

TSH does not provide, perform, control, inspect, or guarantee the quality, safety, legality, or results of any Vendor's products or services. Listing on the Platform, including as a "Premium" or featured Vendor, is not an endorsement, certification, or warranty by TSH of your business or its work.

TSH does not guarantee any specific number of leads, views, inquiries, calls, bookings, or driver placements from any subscription plan, and makes no promise about business results.

Any dispute, claim, injury, property damage, or financial loss arising from a Vendor's actual products or services — including work performed, parts sold, coverage issued, or drivers placed — is strictly between the Vendor and the affected driver, company, or third party. TSH is not a party to that relationship and bears no responsibility for it.

The Service is advertising and directory placement — nothing more. TSH sells visibility, not outcomes: no guaranteed leads, no guaranteed drivers, no guaranteed results of any kind. If a plan is working for you, keep it. If it isn't, your only obligation to yourself is to cancel it under Section 4 — that is the remedy this Service offers for dissatisfaction of any kind, not a claim, dispute, or demand against TSH.

7. Indemnification

You agree to indemnify, defend, and hold harmless Truck Service Hub LLC, its sole member, and Marko Cekerevac individually, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the products or services you provide to any driver, company, or third party; (b) your breach of these Terms; (c) your violation of any law, regulation, or third party's rights; or (d) any content, claim, or information you submit to the Platform.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TSH DOES NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT YOUR LISTING WILL DISPLAY CORRECTLY OR CONTINUOUSLY AT ALL TIMES, AND TSH IS NOT LIABLE FOR ANY DOWNTIME, BUG, DISPLAY ERROR, OR DATA LOSS, INCLUDING THOSE CAUSED BY THIRD-PARTY SERVICES SUCH AS OUR HOSTING PROVIDER OR PAYMENT PROCESSOR. TSH IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, LEADS, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY.

TSH'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE TOTAL FEES YOU ACTUALLY PAID TO TSH IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE CLAIM AROSE.

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SERVICE, FOR ANY REASON, IS TO CANCEL YOUR SUBSCRIPTION UNDER SECTION 4. THIS LIMITATION APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW EVEN IF A REMEDY UNDER THESE TERMS FAILS ITS ESSENTIAL PURPOSE.

9. Intellectual Property

TSH retains all rights, title, and interest in the Platform, its website, software, design, and trademarks. By submitting your business name, logo, description, or other content, you grant TSH a non-exclusive, royalty-free, worldwide license to display and use that content to create and operate your listing, and to promote the Platform (including in marketing and on social media), for as long as your listing remains active plus a reasonable period after removal for archival purposes.

You may not use TSH's name, logo, or trademarks, or state or imply that your business is "certified," "endorsed," "partnered with," or otherwise affiliated with TSH beyond being a listed Vendor, without TSH's prior written consent.

10. Term & Termination

These Terms remain in effect month-to-month for as long as you maintain a vendor account or subscription. TSH may suspend or terminate your account immediately, without refund, for: breach of these Terms, non-payment, providing false information, illegal activity, or conduct TSH reasonably believes is harmful to drivers, other Vendors, or the Platform. Sections 6, 7, 8, 9, and 11 survive termination.

11. Governing Law, Venue & Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

Exclusive Venue. Any claim or dispute arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Wyoming. You consent to personal jurisdiction in those courts and waive any objection that Wyoming is an inconvenient forum, regardless of where you or your business are located.

Class Action Waiver. Any claim must be brought by you individually, in your own name, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You waive any right to participate in such a proceeding against TSH.

Jury Trial Waiver. To the fullest extent permitted by law, you and TSH each waive any right to a trial by jury in any action arising out of or relating to these Terms.

Time Limit on Claims. Any claim you have arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose, or it is permanently barred, regardless of any longer period that might otherwise apply by law.

Attorneys' Fees. In any dispute between you and TSH arising from these Terms, the party that prevails is entitled to recover its reasonable attorneys' fees and costs from the other party.

12. Changes to These Terms

TSH may update these Terms from time to time. Material changes will be posted on this page with an updated Effective Date and, where practical, emailed to the address on file. Continued use of your vendor account after changes take effect is your acceptance of the updated Terms.

13. Affiliate & Referral Arrangements

In addition to subscription fees under Section 3, TSH may, in its sole discretion, enter into a separate referral or affiliate arrangement with a Vendor under which TSH is compensated for driver or company signups, applications, purchases, or other actions TSH refers to that Vendor (for example, a fuel card activation or an insurance policy bound through a TSH referral). No Vendor is required to enter into such an arrangement to be listed on the Platform, and being a paid or free Vendor does not by itself create any referral or commission relationship.

Where TSH and a Vendor agree to a referral or affiliate arrangement, the specific commission rate, triggering event, payment terms, reporting, and tracking method are set out in a separate written addendum signed by both parties (a "Referral Addendum"). The Referral Addendum is governed by, and incorporates, these Terms — including Sections 7 (Indemnification), 8 (Limitation of Liability), and 11 (Governing Law, Venue & Disputes) — unless the Referral Addendum expressly states otherwise.

TSH's role under any Referral Addendum is limited to referring or introducing drivers or other users to the Vendor. TSH does not sell, underwrite, bind, or issue any Vendor's product (including any insurance policy), and TSH is not a party to the resulting transaction between the Vendor and the referred driver or user.

14. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and TSH regarding the Service. If any provision is found unenforceable, the rest remains in effect. TSH's failure to enforce a provision is not a waiver of it. You may not assign these Terms without TSH's written consent; TSH may assign these Terms in connection with a merger, sale, or transfer of its business. Neither party is liable for delays caused by events beyond its reasonable control. Notices to TSH should go to the contact information below; notices to you will go to the email on file for your account. Your electronic acceptance of these Terms — including by checking a box or clicking "I agree" — is a legal signature and is as binding as a handwritten signature, to the fullest extent permitted by the U.S. ESIGN Act and applicable state law.
